1. Subject matter and scope
1.1. These General Conditions of Sale are agreed upon by martaprozil.pt and persons wishing to make purchases through the martaprozil.pt website, hereinafter referred to as "Customer", and in no way contrary to the law in force.
1.2. These conditions apply only to natural persons who are not traders.
1.3. The parties agree that purchases made through this website will be governed exclusively by this agreement to the exclusion of any conditions.
1.4. Considering that the online sales environment is naturally different from the one in our store Marta Prozil - Atelier de arteanato de Viana, for that reason the General Conditions of Sale at martaprozil.pt are specific and prevail whenever there are inconsistencies in the treatment that is provided on this site and practiced in our store.
2. Specificity of products and content presented
2.1. In this area of online sales, martaprozil.pt puts at the customer's disposal various products, namely handicraft products, which by their nature are handmade; result from the peculiarity of being exclusive and unrepeatable, because they are handmade. For this reason, it is not possible to guarantee that they are exactly the same as the specimen shown in the photograph.
2.2. Each product is accompanied by a description and all the necessary information. We want to ensure that all information disclosed is free of publication errors. Whenever we detect an error that could significantly alter the conditions that led to the performance of this agreement, we will contact you to decide, as indicated here, on its maintenance.
2.3. The images presented are intended exclusively to illustrate the indicated article and are not part of the contractual link of purchase and sale between martaprozil.pt and the client.
2.4. The color tones of the product images displayed on the screen of your equipment may differ from the reality and depend on factors outside the sphere of responsibility of martaprozil.pt, such as, for example, the characteristics of your computer equipment.
3. Order at martaprozil.pt
3.1. You can place your order on our site martaprozil.pt, 24 hours a day.
3.2. You may send your order on this website through the checkout process, after using the device online, by selecting "Add to basket" from the online catalog displayed on the website.
3.3. In this process, the customer must verify that the products he has selected are intended for the intended use. The use of a product for purposes other than those presented on the site may lead to the total or partial cancellation of the warranty.
3.4. To send your order the customer must add the information and choose the options that are available to him during the process of "check out" (address of delivery and billing, form of sending, form of payment among other requests).
3.5. The delivery of the order by the customer is equivalent to the full and complete acceptance of the prices and description of the products available for sale, as well as the general conditions of sale that will be the only ones applicable to the contract thus concluded.
3.6. Martaprozil.pt will honor the orders received online only up to the limit of available stocks, and in the absence of availability of the product undertakes to inform the Customer within 24 to 48 hours.
4.1. Martaprozil.pt proposes to the customer the use of the different types of payment:
Credit card (Visa and MasterCard)
Orders that are not paid within three business days will be canceled.
4.2. The customer pays a global sum corresponding to the costs of handling the order (shipping costs etc).
4.3. Martaprozil.pt guarantees the maximum confidentiality and security in the data transmitted through the internet.
5.1. The prices must be understood in Euros, with taxes and taxes included, taking into account the VAT in force on the date of payment of the order.
5.2. The prices shown in the check-out process always correspond to the most current prices, however, they should only be considered valid while they are visible on this website in a refreshed page (uncoated pages may show prices that are no longer in force ). The price shown is only guaranteed under these conditions and only after the order is duly registered.
6. Delivery terms and shipping charges
6.1. Shipping rates are applied by order. The exact price of each shipment depends on the country of delivery and the weight of the packaging.
6.2. Orders will only be processed once the payment is received. The order may take 2 days to process.
6.3. Delivery times: your order will be sent by CTT: shipments to mainland Portugal take at least three to five business days. For abroad, the delivery times usually are around one week (for Europe) or two (for the rest of the world).
6.4. The address indicated by the customer may be a private address, a place of work or any other direction indicated. There is no need for the billing direction and shipping direction to match. The correct indication of the address is the responsibility of the client.
6.5. If no one is at the indicated address, the order will be at the CTT station in the area of the abovementioned address for 5 business days, after which it will be returned to martaprozil.pt.
In the event that the order is returned to the sender because a new delivery has not been arranged in due time, due to the customer being absent from the address not answering the mobile phone or responding to an email, the resend will only be made by re-payment of the shipping costs.
6.6. In case of international shipments, we guarantee the shipment of your order to the country of destination by registered mail, and the registration number of the order will be transmitted to the customer, so that he can follow the shipment. However, we do not take full responsibility for eventual customs duties and restrictions on the entry of products in certain destinations, particularly outside the European Union. It is up to the client to check with the local import authorities for any additional procedures required.
6.7. In case the delivery service finds a high risk of damages in the transport of the products to the place of delivery or assembly can advise against its realization. In this case, if the customer wishes to oppose this advice, the transport will be at his own risk and responsibility, not accepting martaprozil.pt. resulting from consequential damages.
6.8. Collection in store: the client can collect your order in the shop-studio Marta Prozil, Rua Grande 17, 4900-542 Viana do Castelo. You will have to select "Collect in Store".
6.9. Martaprozil.pt seeks to ensure that the products we deliver to you are in perfect condition and according to the request you have made. However for your safety we recommend the following procedures:
(A) Check that the outer packaging does not show signs of abuse;
B) Open the packages in the indicated areas and keep them in good condition for a period of 48 hours;
C) Verify that the products do not present visible defects of transport or manufacture;
6.10. Martaprozil.pt makes every effort to meet the delivery deadlines with customers. In the event of unforeseen events that result in non-delivery of the article on the date confirmed by martaprozil.pt, the customer may choose to reschedule the delivery to a new date or alternatively to terminate the contract without additional costs, being refunded all amounts delivered in the terms indicated in chapter 7 of this agreement.
Return of products
Martaprozil.pt makes every effort to ensure that all the services we provide and all the products we sell are in perfect conditions of use and in accordance with the technical characteristics we publish. Nevertheless anomalies can occur, reason why we assume to solve them quickly within the legal framework and of our possibilities.
Thank you in advance for your best understanding and remind us that for a quicker resolution of your case you should take into account the procedures at the reception as described in section 6.9. terms and conditions.
7.1. Return Acceptance Conditions
7.1.1. Products which show visible defects in transport or manufacture, or which do not conform to the characteristics presented and technical specifications, may be returned within 14 days of the day on which the customer or a third party indicated by him or her the physical possession of the goods.
7.2. The client can also make an anomaly complaint to the telephone +351 258 824 984 from Monday to Friday from 9:30 am to 6:30 pm, or via the electronic address email@example.com, or by registered letter to the address Marta Prozil, Atelier de Artesanato de Viana, Rua Grande 17, 4900-542 Viana do Castelo, Portugal.
7.3. Returns of products are carried out under the conditions indicated below:
7.3.1. The customer must request to martaprozil.pt the removal of the article at the address where it was delivered or the customer must send the article that was delivered to him for return.
7.3.2. According to Article 13, paragraph 2 of DL 24/2014 of February 14, martaprozil.pt will charge the cost corresponding to the collection services.
7.4. The customer agrees to keep the products that he intends to return in the conditions in which they were delivered, with the original packaging, labels, etc. and in a reasonable state of preservation, without showing signs of use or wear, in order to allow its resale.
7.5. In case of exchange, if the cost of the new order is higher, the customer will have to pay for the difference, adding to the exchange request the payment of the remainder or doing so at the time of the new order being withdrawn.
7.6. Charges for return.
Within the scope of the right of free resolution (article 10, paragraph 1 of DL 24/2014 of February 14), the customer may return the products without having to justify the reason for the return, provided that he manifests his intention by registered letter sent to Marta Prozil, Rua Grande 17, 4900-542 Viana do Castrelo, Portugal within 14 days of receipt of the order. In this case the return is considered the responsibility of the customer.
7.7. In case of a return of the responsibility of the customer to martaprozil.pt will charge the transport costs.
7.8. Exception to the right of free resolution: it is not possible to exercise the right of free termination of the contract in respect of the following products:
A) Goods made according to customer specifications or manifestly personalized;
7.9. Whenever refunds of amounts paid by the customer are made, martaprozil.pt undertakes to make every effort to have them effected as soon as possible.
7.10. Within 14 days of the date martaprozil.pt is informed of the decision to terminate the contract, martaprozil.pt will reimburse the consumer of all payments received, including the costs of initial delivery of the item under n Article 2 (2) of Decree-Law 24/2014 of February 14 (amended by Law 47/2014 of 28.07).
7.11. Repayment of payments will be made through the same means of payment that has been used by the customer in the initial transaction, unless otherwise agreed and provided that the customer does not incur any costs as a consequence of the refund.
7.12. Martaprozil.pt is not obliged to reimburse the additional costs of delivery when the customer expressly requests a different and more costly mode of delivery than the commonly accepted and less expensive mode proposed by martaprozil.pt.
7.13. Reimbursement of reimbursement is only allowed for as long as the articles are not received or as long as the consumer does not provide evidence of the return of the article.
8. Litigation and Liability
8.1. For any litigation arising from the application of these General Conditions of use and sale will be competent a court of the county of Viana do Castelo with waiver of any other.

In case of litigation, the consumer may use this Dispute Resolution Entity.
9. Suggestions, complaints, opinions and comments
9.1. In order to allow a personalized and constructive treatment of your suggestions, complaints, opinions and comments, we always ask you to register as a client.
9.2. The information, suggestions and opinions of third parties displayed on martaprozil.pt are the exclusive responsibility of their authors.
9.3 To prevent the display of opinions and comments that may violate the rights and freedoms of third parties, submitted texts are evaluated by an internal team.
9.4 martaprozil.pt reserves the right not to publish opinions that violate its rights or the rights and freedoms of third parties.
9.5. Martaprozil.pt seeks to permanently improve the service provided to its client. Thanks in advance for any constructive feedback to improve our service.
10. Intellectual property
10.1. All elements present at martaprozil.pt, whether visual or sound, including the underlying technology, are protected by copyright, trademark or patent. They are the exclusive property of Marta Prozil.
